We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms, or if we believe that such content is objectionable or otherwise inappropriate.
Some services may require payment of fees. By using such services, you agree to pay all applicable fees and charges associated with your use of the services. All fees are non-refundable unless otherwise stated. You are responsible for providing accurate payment information and for ensuring that your payment method is valid and up to date.
gpdinoflagellate reserves the right to change its fees and payment terms at any time. Any changes will be communicated to you in advance, and your continued use of the services after such changes constitutes your acceptance of the new fees and payment terms.
In the event of a dispute regarding any payment, you must notify us within 30 days of the date of the disputed charge. Failure to notify us within this timeframe will result in your waiver of any claims related to the disputed charge.
gpdinoflagellate reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that gpdinoflagellate will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.
We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms of Service.
It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any modifications to the Terms will constitute your acceptance of the modified Terms.
To the fullest extent permitted by applicable law, in no event shall gpdinoflagellate, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
In no event shall gpdinoflagellate’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
These Terms of Service are effective until terminated by either you or gpdinoflagellate. You may terminate these Terms at any time by discontinuing your use of the services and destroying all materials obtained from the services. gpdinoflagellate may terminate these Terms at any time, without notice, for any reason, including but not limited to your breach of these Terms.
Upon termination of these Terms, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Termination of your account may also result in the deletion of your User-Generated Content, and gpdinoflagellate shall not be liable for any loss of such content. It is your responsibility to back up any User-Generated Content prior to termination.
